The victims claim Apple’s failure to implement a promised child safety tool, which initially led to the abuse material to continue circulating. A 27-year-old woman filed the lawsuit and she still seems to receive notifications from law enforcement when they arrest individuals who have sensitive images of her from when she was a child. Her story goes back a long time when she was still an infant. The abuse began when a relative molested her, took photographs, and shared images with others online. The abuser also allowed other men to spend time with her, which multiplied the abuse. 

Even though that happened in her childhood, she is still reminded and traumatized even at the age of 27. She gets notifications every other day when someone has been charged for possessing those images. In 2021, one such warning said that the photos had been discovered on a man’s MacBook and then verified that they were saved in Apple’s iCloud. The issue was that the woman received the message months after Apple had launched a capability to illegally scan photos of sexual abuse. This on-device tool would help identify and report who stored child abuse material on their iCloud Photos accounts. However, Apple had to abandon the tool after facing criticism from cybersecurity experts. This feature received disagreement from customers, privacy groups, and even WhatsApp. Many claimed that this feature would be a setback for people’s privacy. 

The woman filed the lawsuit saying Apple failed to protect victims like her. She also argued that instead of using tools to identify and report such child abuse crimes, Apple allows those images to circulate, forcing victims like her to be traumatized for the rest of their lives. The lawsuit was filed in the U.S. District Court in Northern California, which states that Apple is selling defective products as they introduced a tool and failed to implement it while taking no measures to detect and limit such child abuse material. Also, thousands of victims have sued Apple for its failure to keep its promise to detect and report illegal child pornography or child sex abuse materials (CSAM). The suit claims to change Apple’s practices and compensate the 2,680 victims. Under the law, the victims of child sexual abuse should be compensated a minimum of $150,000, and considering all the damages, Apple is liable for $1.2 billion in compensation for the victims.

Apple has filed a motion to dismiss the North Carolina case, arguing that iCloud cannot be subjected to a product liability claim because it was not a product. Also, Apple claims that Section 230 protects it from liability for child abuse materials posted on iCloud by someone else. The Apple spokesperson said that they are urgently and actively taking measures to combat these crimes without compromising the security and privacy of users. Many more victims are coming forward to demand accountability from Apple but Apple has rejected helping the victims by claiming that Apple did not advertise child sex abuse material on its platform devices. Even though Apple came up with the idea of introducing a tool, many other platforms opposed it, leaving it mid-way. As a result, many women believe that this is what led to the circulation of child abuse material images. However, Apple is taking measures to ensure the privacy and security of users.
